1. Acceptance of terms

These Terms of Use ("Terms") govern your access to and use of the Moony mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of the service

Moony is a mobile application for mixing ambient sounds to help you sleep, focus and relax. Features include a library of sounds you can blend with independent volume controls, saved mixes and favourites, and a sleep timer.

3. Eligibility

You must be at least 13 years of age to use Moony. By using the App, you represent that you meet this requirement. If you are under 18, you should review these Terms with a parent or guardian.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App or its content
• Extract, record or redistribute the App's audio
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without our prior written consent
• Attempt to gain unauthorized access to any portion of the App

5. Intellectual property

All content within Moony — including the app design, logo, mascot, icons, text and audio — is the property of Moony or its licensors and is protected by applicable intellectual property laws. If you believe any content infringes a copyright you own, please contact us.

6. User conduct

You agree to use the App only for lawful purposes. You must not use the App in any way that:

• Violates any applicable local, national, or international law or regulation
• Is harmful, fraudulent, deceptive, threatening, or abusive
• Interferes with the normal operation of the App or its services

7. Notifications

If you enable notifications in the App, you consent to receive reminders you have requested. You may revoke this consent at any time through your device's notification settings.

8. Subscriptions and free trial

Moony offers an auto-renewing subscription ("Moony Pro") that unlocks the full App. New subscribers may be offered a 3-day free trial. The price, billing period and trial details are shown before you confirm your purchase.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase, or at the end of the free trial.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the App does not cancel your subscription.
• Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
• All purchases are processed by Apple or Google and are subject to their terms. Refunds are handled by Apple or Google according to their policies, except where applicable law requires otherwise.

9. Health and hearing

Moony is designed for relaxation, focus and sleep support. It is not a medical device and does not provide medical advice, diagnosis or treatment. If you have a health condition, including a sleep disorder, consult a qualified professional.

To protect your hearing, keep the volume at a comfortable level. Do not use Moony in situations where you need to hear your surroundings, such as while driving or operating machinery.

10. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the maximum extent permitted by applicable law, Moony and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

12. Privacy

Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is otherwise harmful to other users, us, or third parties. You may stop using the App at any time by uninstalling it from your device.

14. Changes to these terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

15. Governing law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
